Experts in employer mandated federal identity theft laws (FACTA) present what your organization needs to know to be compliant in light of the Red Flags Clarification Act passed in December 2010. All businesses are required to comply with FACTA (Fair and Accurate Credit Transaction Act) regulations and the governing agency, the FTC, will levy substantial penalties on companies losing the PII (Personal Identifiable Information) of employees and customers due to noncompliance to these regulations. A loss of PII of employees and customers may also result in class-action lawsuits and civil litigation.
With 52% of all identity theft happening in the workplace, the government is taking the protection of employee information seriously. The reality is that 20% of all identity theft happens in healthcare with 88% of all identity thefts are being done by employees and 90% involve employee and payroll records.
Congress has given the FTC authority to continue in 2012 their investigation of non compliance with FACTA and federal consumer laws over all organizations that do not fall within the federal banking jurisdiction.
In this session you will receive information on FACTA that will enable you to identify those areas in your business addressed by FACTA. Following this session you will:
- Know what FACTA is and what the federal law states.
- Know why Red Flags Clarification was enacted into law and find out if you are exempt.
- Know what makes FACTA compliance different from HIPAA compliance.
